Welcome to Simalons Adventures. These Terms & Conditions (“Terms”) govern all bookings, safaris, tours, and related services provided by Simalons Adventures (“we”, “us”, “our”) to any client or traveler (“you”, “your”).

2. Scope of Services
Simalons Adventures organizes and operates:
- Safari tours and wildlife experiences in Kenya and Tanzania
- Accommodation bookings (through partner lodges/camps/hotels)
- Transport and transfers
- Excursions, cultural visits, and related tourism services
We act either as a direct operator or as an agent for third-party service providers (lodges, airlines, transport companies, etc.).
3. Bookings & Confirmations
3.1 Making a Booking
A booking may be made through our website, email, phone, WhatsApp, or through an authorized travel agent.
3.2 Booking Information
You must provide accurate and complete information including full names (as per passport/ID), contact details, travel dates, number of travelers, and any special requirements (e.g., dietary, medical, mobility).
3.3 Confirmation
A booking is considered confirmed only when:
- You have accepted our written itinerary and price, and
- You have paid the required deposit or full amount, and
- We have issued a written confirmation/invoice.
4. Payments
4.1 Deposit
A non-refundable deposit (percentage or fixed amount as indicated in your quotation/invoice) is required to secure your booking. Failure to pay within the specified time may result in automatic cancellation.
4.2 Balance Payment
The balance must be paid by the due date shown on your invoice (usually a set number of days before departure). If full payment is not received on time, we reserve the right to cancel the booking and apply our cancellation terms.
4.3 Payment Methods
Payment methods may include:
- Bank transfer
- Mobile money (e.g., M-Pesa or other agreed services)
- Card payments or online payment links (where available)
All bank charges, transfer fees, and currency conversion costs are your responsibility unless otherwise stated.
4.4 Pricing & Currency
Prices are quoted in the currency specified in your quotation (commonly USD or KES) and are based on current rates for accommodation, park fees, fuel, taxes, and exchange rates at the time of quotation.
We reserve the right to adjust prices before final confirmation in case of significant changes in park fees, taxes, fuel surcharges, or exchange rates.
5. Changes & Amendments
5.1 Changes by You
If you wish to change dates, accommodation, or itinerary after confirmation, we will make reasonable efforts to assist. Any additional costs, penalties, or amendment fees imposed by suppliers will be passed on to you.
5.2 Changes by Us
We may occasionally need to make changes due to operational, safety, weather, or supplier reasons. Where possible, we will:
- Offer an alternative of equal or higher standard, or
- Offer a suitable lower-cost alternative with a refund of the difference, or
- If no reasonable alternative is available, offer a partial refund as per our Refund Policy.
6. Cancellations
6.1 Cancellation by You
If you cancel your booking, cancellation charges will apply in accordance with our Cancellation & Refund Policy (see separate page). These charges reflect costs already incurred and supplier terms.
6.2 No-Show
If you fail to arrive for your safari or service without prior notice, this will be treated as a no-show, and 100% of the total booking cost may be forfeited.
6.3 Cancellation by Us
We reserve the right to cancel a tour in exceptional circumstances (e.g., force majeure, safety concerns, supplier failure). In such cases, we will:
- Offer an alternative date or itinerary where possible, or
- Provide a refund in accordance with our Refund Policy, minus any non-recoverable costs.
7. Travel Documents & Insurance
7.1 Travel Documents
You are responsible for ensuring you have valid:
- Passport and/or ID
- Visas and entry permits
- Vaccination certificates (if required)
We are not liable for any consequences if you fail to secure the necessary travel documents.
7.2 Travel Insurance
We strongly recommend that all travelers have comprehensive travel insurance covering:
- Medical expenses
- Evacuation and repatriation
- Trip cancellation and curtailment
- Loss or damage to baggage and personal items
8. Health, Safety & Fitness to Travel
You must inform us of any existing medical conditions, disabilities, or special needs which may affect your participation in the safari.
Some tours may involve long drives, uneven terrain, and outdoor conditions. By booking, you confirm that you and all members of your party are physically and mentally fit to participate.
We reserve the right to decline a booking or remove a traveler from a tour if their condition poses a risk to themselves or others.
9. Wildlife, Risk & Liability
9.1 Assumption of Risk
Safaris and outdoor activities involve inherent risks including, but not limited to, encounters with wild animals, varying weather, and road conditions. By participating, you acknowledge and accept these risks.
9.2 Limitation of Liability
To the fullest extent permitted by law, Simalons Adventures shall not be liable for:
- Any illness, injury, death, loss, damage, or expense arising from acts or omissions of third-party suppliers
- Loss or damage to personal belongings
- Delays, changes, or cancellations caused by force majeure events including but not limited to natural disasters, strikes, war, pandemics, government restrictions, or road/park closures
Our total liability for any claim arising out of a booking shall not exceed the total amount paid for the services in question.
10. Complaints & Dispute Resolution
If you experience any issue during your trip, you must notify your driver-guide or our office immediately, so we have an opportunity to resolve the matter on the spot where possible.
Formal complaints should be submitted in writing to support@simalonsadventures.com within 14 days of the end of your trip.
We will review and respond within a reasonable timeframe and may propose appropriate remedies where justified.
11. Intellectual Property
All content on our website, including text, images, logos, itineraries, and designs, is the property of Simalons Adventures or its licensors and may not be copied, reproduced, or used without prior written permission.
12. Privacy
We collect and process personal information in accordance with our Privacy Policy. By using our services, you agree that we may use your data for the purposes of handling your booking and improving our services.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of Kenya. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya, unless otherwise agreed in writing.
14. Updates to These Terms
We may update these Terms from time to time. Any changes will be posted on our website with a revised “Last Updated” date. Continued use of our services constitutes acceptance of the updated Terms.
